OVERVIEW
Welcome to FIRST LIGHT.
The terms “we”, “us” and “our” refer to FIRST LIGHT. We operate this website and online store, including the information, content, features, tools, products and services made available through it (the “Services”).
Our store is powered by Shopify, which enables us to provide our online store and Services to you.
These Terms of Service (“Terms”), together with our Privacy Policy, Refund Policy and Shipping Policy, govern your access to and use of our Services and purchases made through our store.
By accessing our website, using our Services or placing an order, you agree to these Terms.
Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies you may have under the Australian Consumer Law (ACL) or any other applicable law that cannot lawfully be excluded, restricted or modified.
1. ELIGIBILITY AND ACCOUNTS
By using our Services, you represent that you are legally capable of entering into an agreement with us or that you have the permission of a parent or legal guardian where required.
When placing an order or creating an account, you agree to provide accurate, current and complete information.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account.
2. PRODUCTS
We make reasonable efforts to ensure that product descriptions, photographs, colours, measurements and other information displayed on our website are accurate.
However, colours and appearance may vary depending on your device, screen settings, lighting and other factors.
Sizing information is provided as a guide. Where available, customers should review the relevant size guide before ordering.
We may modify or discontinue products and may limit product quantities or availability at any time, subject to applicable law.
Nothing in this section limits your rights under the Australian Consumer Law where a product does not match its description, is faulty, is not of acceptable quality or otherwise fails to satisfy an applicable consumer guarantee.
3. ORDERS
Placing an order constitutes an offer to purchase the selected products.
An order is accepted when we confirm acceptance of the order and payment has been successfully processed.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:
- a product is unavailable;
- pricing or product information contains an obvious error;
- payment cannot be authorised;
- we reasonably suspect fraud or unauthorised activity; or
- we are unable to fulfil the order.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled product or order.
Customers should check their order details carefully before submitting an order.
Where our store provides an automated cancellation window, eligible unfulfilled orders may be cancelled within that displayed period. After that period, we may already have begun processing the order and cannot guarantee that a cancellation request can be accommodated.
Returns and exchanges are handled in accordance with our Refund Policy and your rights under Australian Consumer Law.
4. PRICES AND PAYMENT
Unless otherwise stated, all prices displayed on our Australian store are in Australian dollars (AUD).
Prices, promotions and discounts may change from time to time.
The price applicable to your purchase is the price displayed at checkout when your order is placed, subject to correction of obvious pricing errors and applicable law.
Shipping charges, where applicable, will be displayed before you complete checkout.
You agree to provide accurate billing and payment information and confirm that you are authorised to use the payment method provided.
5. SHIPPING AND DELIVERY
We aim to process and dispatch orders within the timeframes stated on our website.
Delivery dates and timeframes are estimates and may be affected by circumstances outside our reasonable control, including carrier delays, severe weather, public holidays and other disruptions.
Where tracking is available, tracking information will be provided after dispatch.
If your order is significantly delayed, lost, damaged in transit or does not arrive, please contact us at Hello@firstlightaus.com so that we can investigate and provide an appropriate solution.
Nothing in this section excludes or limits any rights or remedies available under the Australian Consumer Law.
6. RETURNS, EXCHANGES AND CONSUMER GUARANTEES
For eligible change-of-mind returns, FIRST LIGHT offers a 30-day return period starting from delivery, subject to the conditions contained in our Refund Policy.
Unless otherwise stated in our Refund Policy, customers are responsible for return shipping costs for change-of-mind or incorrect-size returns.
This change-of-mind policy is separate from your rights under Australian Consumer Law.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in our Refund Policy, any stated return period, any “final sale” designation or these Terms excludes or limits rights that cannot legally be excluded under Australian Consumer Law.
7. INTELLECTUAL PROPERTY
Unless otherwise stated, the content available through the Services, including the FIRST LIGHT name, logos, branding, designs, graphics, photographs, videos, product designs, text and other content, is owned by or licensed to FIRST LIGHT and is protected by applicable intellectual property laws.
You may access and use our website for personal, non-commercial purposes.
Unless permitted by law or authorised by us in writing, you must not reproduce, distribute, modify, republish, commercially exploit or create derivative works from our content.
The FIRST LIGHT name, logos and associated branding must not be used in a way that suggests affiliation, endorsement or authorisation without our prior permission.
Shopify’s names, logos and trademarks remain the property of Shopify and its applicable licensors.
8. THIRD-PARTY SERVICES AND TOOLS
Our Services may provide access to tools, applications, payment services, social platforms or other services operated by third parties.
Your use of third-party services may also be subject to the third party’s own terms and privacy policies.
To the extent permitted by law, we are not responsible for services operated independently by third parties.
Nothing in this section limits any liability that cannot lawfully be excluded.

We do not control third-party websites and are not responsible for their content, availability, privacy practices or terms.

10. SHOPIFY
FIRST LIGHT is powered by Shopify, which provides technology used to operate our online store.
Purchases made from FIRST LIGHT are transactions between you and FIRST LIGHT, not between you and Shopify.
Shopify may process certain information in connection with providing its services to us. For more information about the processing of personal information, please review our Privacy Policy and the applicable Shopify privacy information.
Nothing in this section limits any rights you may have under applicable law.
11. PRIVACY
Personal information collected through our Services is handled in accordance with our Privacy Policy and applicable privacy laws.
Because our store is hosted using Shopify, certain information may also be processed by Shopify and other service providers that help us operate our store, process payments, fulfil orders, analyse performance or provide other Services.

12. REVIEWS, FEEDBACK AND USER CONTENT
If you submit a review, photograph, comment, suggestion or other content to FIRST LIGHT, you confirm that you have the right to submit that content.
You grant FIRST LIGHT a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish, display and share that content for legitimate business and promotional purposes, subject to applicable law.
You must not submit content that:
- infringes another person’s intellectual property or privacy rights;
- contains unlawful, defamatory, abusive or misleading material;
- contains malicious software; or
- falsely represents your identity or experience.
Where a review or endorsement has been incentivised, any required disclosure must be made.
We may moderate or remove content where reasonably necessary, including content that breaches these Terms or applicable law.
13. ERRORS AND INACCURACIES
Occasionally, information on our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, availability, shipping charges or delivery estimates.
We may correct genuine errors and update information where reasonably necessary.
If an error materially affects an order you have already placed, we will contact you where appropriate and provide any remedy required by applicable law.
14. PROHIBITED USES
You must not use our Services:
- for unlawful or fraudulent purposes;
- to infringe the intellectual property or other rights of another person;
- to distribute malware or malicious code;
- to interfere with the security or operation of our Services;

- bypass technical restrictions designed to control automated access;
- misrepresent themselves as human users; or

We may limit or block Agent access where reasonably necessary.
Nothing in this section prevents authorised shopping services, search engines, Shopify functionality or other services that we have expressly enabled from accessing permitted portions of our store.
16. DISCLAIMER AND AUSTRALIAN CONSUMER LAW
We aim to keep our Services accurate, secure and available, but we cannot guarantee that our website will always operate uninterrupted or without technical errors.
To the maximum extent permitted by law, we exclude warranties or conditions that may otherwise be implied.
However, nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or other protection under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified.
17. LIMITATION OF LIABILITY
To the maximum extent permitted by law, FIRST LIGHT will not be liable for indirect or consequential loss arising solely from your use of the Services where such liability may lawfully be excluded.
Nothing in these Terms excludes, restricts or modifies liability for:
- fraud;
- wilful misconduct;
- personal injury where liability cannot lawfully be excluded;
- breach of an applicable consumer guarantee; or
- any other liability that cannot legally be excluded or limited.
Where the Australian Consumer Law applies, your rights and our liability are determined in accordance with that law.
18. INDEMNITY
To the extent permitted by law, you are responsible for loss suffered by FIRST LIGHT resulting directly from your unlawful use of the Services or your material breach of these Terms.
This section does not require you to indemnify FIRST LIGHT for loss caused by our own negligence, breach of law or wrongful conduct.
19. TERMINATION AND SUSPENSION
We may suspend or terminate access to the Services where reasonably necessary, including where we reasonably believe a user has engaged in fraud, unlawful activity, security abuse or a material breach of these Terms.
Termination does not affect rights or obligations that arose before termination.
Provisions that by their nature should continue after termination will remain in effect.
20. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be severed or limited to the minimum extent necessary.
The remaining provisions will continue to apply.
21. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy and any other policies expressly incorporated into them, constitute the agreement governing your use of the Services.
Nothing in this section excludes rights arising under applicable law.
22. GOVERNING LAW
These Terms are governed by the laws of Victoria, Australia, and applicable Commonwealth laws of Australia.
Subject to any rights you have to bring proceedings elsewhere under applicable consumer law, the parties submit to the jurisdiction of the courts and tribunals of Victoria and applicable Commonwealth courts.
23. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our Services, business practices or legal obligations.
The current version will be published on this page with the date it was last updated.
Where required by applicable law, we will provide appropriate notice of material changes.
Changes will not retrospectively remove rights that have already accrued under applicable law.
